GENERAL TERMS AND CONDITIONS OF SALE

1 – OBJECT & ACCEPTANCE

These General Terms and Conditions of Sale (GTCS) define the rights and obligations of the Client and MasterTack, a trading name of Ash Investments SAS, through the sale of goods offered via the website: – http://mastertack.com. Hereafter sometimes referred to as the site.

These GTCS apply to the relations between the Client and MasterTack upon confirmation of order on the site http://www.mastertack.com.

Part of the purchase process involves the client accepting our GTCS in order to complete the order. The simple act of acceptance, by the client, is considered as final and irrevocable consent on the part of the client of all the provisions contained within these GTCS.

2 - PRICES

All Prices are shown in Euros, including VAT (Tax) and excluding any delivery charges.

Any purchased goods must be fully paid before delivery either by: -

-       Bankers cheque or draft made payable to – ASH INVESTMENTS (This is acceptable for French clients only.

-       Bank transfer (International clients)

-       Pay pal or credit card.

All products remain the property of MASTERTACK until they are fully paid by the client.

All good remain the property of MasterTack (Ash Investments SAS) until fully paid for.

The goods, products or services sold by MasterTack are for private individuals, professionals and businesses.

3 -SHIPPING:

Shipping of goods purchased from the site takes place as fast as possible, normally within 3 to 5 working days excluding weekends, to the delivery address provided by the client upon order confirmation. Delivery is affected by the French postal service Colissimo.

Prices: - as of Oct 2011 (including packaging)

FRANCE:             Up to             500 g                         - 6 Euros

                          From             501g to 1kg                - 7 Euros

                          From             1.01kg to 2kg             - 8 Euros

EUROPE:             Up to             1kg                           - 16 Euros

                          From             1.01kg to 2kg            - 17.5 Euros

Note: These prices may from time to time vary in accordance with Colissimo tariff

In case a product becomes unavailable, the buyer will be informed by e-mail and will then have the choice to ask for either:

-       A refund, made as soon as possible and no later than 30 days after the cancellation of the order by bank credit, credit card reimbursement, paypal or by check at the option of MasterTack.

-       Or an exchange of product as long as it has the same price as the original order.

IMPORTANCE NOTICES

Damage in delivery:

If a package has visible traces of opening and / or damage, you must complete in the presence the delivering postman a « finding of deterioration » form, which will is required for compensation. Attention: open a package without completing this form an you loose your right to appeal with Colissimo.

Shipping outside of France:

The customer agrees to pay all taxes due to the importation of products, customs duty, value added tax and other taxes payable under the laws of the country receipt of order. MasterTack accepts no legal liabilities or responsibilities for a client not paying the taxes due.

Shipping to CEE countries

Will be done using the French postal service European Colissimo with tracking, shipping outside EEC countries/to other countries will be made using international postal services. In case of a return all or any, shipping costs, taxes, custom duties & charges will not be reimbursed.

4 - INABILITY / REFUSAL OF DELIVERY

If undeliverable (incorrect address) or refusal of receipt by the Client, the package will be returned to MASTERTACK. Upon receipt of the goods the order will be cancelled and a refund made to the Customer, subject to any return shipping costs.

5 - RIGHT OF RETURN

  5.1 Scope of the right of withdrawal

In accordance with Articles L.121-20 & subsequent of the French Consumer Code, all non-professional buyers have a period of 7 working days from the date of delivery of the order, to return without having to justify reason, any item that does not suit him, in its original packaging, with labels of origin, in new condition, and a condition to be re-sold and request a refund without penalty, except for the cost of returning the goods.

  5.2 Exceptions to the right of return

As an exception to Article 5.1 above, the goods or products cannot be returned by the client if;

(i) The products or goods bear the signs of prolonged use, beyond the time required for fitting or testing

(ii) The products or goods are stained or soiled

(iii) Products sold with protective lids or seals have been opened.

6 – PRODUCT

All products distributed by MasterTack carry a manufacturers guarantee. Manufacturers terms vary from one society to another.

  6.1 Western Legacy Sales – Manufacturer of Iconoclast products

Iconoclast protections have a 6-month guarantee against manufacturing defects. Iconoclast protection cannot be machine washed otherwise guarantee will be void.

Before returning a product on guarantee, the buyer will need to get in touch with customer service. If the product is recognized as being defective the seller will give the buyer a return number. The defective product will have to be returned in its original packaging with the return number. All shipping costs will have to be paid by the buyer.

7 - PERSONAL DATA PROTECTION

  7.1 Use of Personal Data

MASTERTACK agrees not to disclose the Customer's personal data for marketing or any other purposes without the express consent of the client and will only use this data as part of order management and its relationship with the Client.

  7.2 Rights of access and correction

Pursuant to the Act of 6 January 1978 relating to computers, files and freedoms, the Customer has a right to oppose, access and rectify personal data.

8 - INTELLECTUAL PROPERTY RIGHTS

  8.1 Prohibition on reproduction

The full site - http://mastertack.com its contents, elements and technologies are protected by copyright, patents and trademarks. Any person wishing to use these elements must first request the written permission of the president of Ash Investments. MasterTack is a trading name of Ash Investments SAS

  8.2 Links

Any hypertext link to the site http://www.mastertack.com is prohibited unless specifically authorized in writing by the president of Ash Investments. MasterTack is a trading name of Ash Investments SAS

9 - MISCELLANEOUS PROVISIONS

  9.1 Responsibilities

MasterTack can be challenged if it cannot perform its obligations due to a third party or an event of force majeure as defined by the French courts.

  9.2 Changing the terms of sale

The Terms apply to a given order are those that have been accepted by Customer in the ordering process. MasterTack nevertheless reserves the right to alter, without notice, the GTCS.

  9.3 Applicable law - Jurisdiction

The GTCS and the relationship between MasterTack and the Customer are subject to French law. In case of dispute, the customer should first contact Customer Services at MasterTack to resolve any dispute amicably. Otherwise, the French courts will have jurisdiction
